Terms of Service

These Terms of Service (“Agreement”) govern your use of the marketing services provided by BlastDash LLC (“Company,” “BlastDash,” “we,” “us,” or “our”). By subscribing to any BlastDash service plan, you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by this Agreement.
1. Services
BlastDash provides fully managed SMS, MMS, and email marketing campaign services. This includes campaign strategy development, message creation, scheduling, sending, and performance reporting. BlastDash is a done-for-you service — clients do not operate any software directly.
2. Subscription and Billing
All services are provided on a monthly subscription basis. You will be billed on the same date each month based on your signup date. Payment is processed automatically via credit or debit card through our payment processor (Stripe). All fees are quoted in U.S. dollars. You are responsible for keeping your payment method current. If a payment fails, BlastDash reserves the right to suspend services until the balance is resolved.
3. Service Plans and Message Allotments
Each subscription plan includes a fixed monthly allotment of SMS/MMS messages and emails as described at the time of purchase. Unused messages do not roll over — any unused portion of your monthly allotment expires at the end of each billing cycle and is forfeited. No credits, refunds, or adjustments will be issued for unused messages.
4. No Refunds
All payments are non-refundable. This includes partial months, unused message allotments, and any period during which you choose not to use the service. By subscribing, you acknowledge and accept this no-refund policy.
5. Chargebacks and Payment Disputes
You agree to contact BlastDash directly to attempt to resolve any billing concern before initiating a chargeback, payment reversal, or dispute with any credit card issuer, bank, or payment processor. Initiating a chargeback for charges incurred under an active subscription, or for services that have been rendered or scheduled, constitutes a material breach of this Agreement. In the event of a chargeback or payment dispute that is determined to be without merit, you agree to reimburse BlastDash for the disputed amount, any chargeback or processing fees imposed by Stripe or other payment processors, and any reasonable costs of collection, including legal fees. BlastDash also reserves the right to immediately suspend or terminate services in the event of any chargeback.
6. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle — you will continue to receive service through the remainder of the period you have already paid for. No partial refunds will be issued for the remaining days in a billing cycle. To cancel, contact us via email or through your account dashboard.
7. Client Responsibilities
You agree to provide BlastDash with accurate and complete information necessary to perform the services, including but not limited to: your customer contact lists, business branding materials, and promotional content or direction. You represent and warrant that all contact lists provided to BlastDash have been collected in compliance with applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any applicable state privacy or messaging laws. You are solely responsible for ensuring that all individuals on your contact lists have provided appropriate prior express consent to receive marketing messages. You are solely responsible for the legality, accuracy, and appropriateness of all content, contact lists, and campaign instructions you provide to BlastDash. Any fines, penalties, lawsuits, regulatory actions, carrier penalties, or third-party claims arising from your content, lists, or instructions are your sole responsibility, and BlastDash shall have no liability for them.
8. Acceptable Use Policy
BlastDash will not send messages or run campaigns that violate the policies of our messaging providers (including but not limited to Twilio) or wireless carrier requirements (including A2P 10DLC standards set by CTIA and the Campaign Registry). Prohibited content categories include, but are not limited to:
- Sex, adult content, dating services, or escort services
- Hate speech, harassment, or discriminatory content
- Alcohol, tobacco, vaping, e-cigarettes, cannabis, CBD, or any controlled substances
- Firearms, ammunition, weapons, or explosives
- Gambling, sweepstakes (where prohibited), lotteries, or sports-betting promotions
- Payday loans, short-term high-interest lending, debt consolidation, debt collection, debt relief, or any high-risk financial services
- Multi-level marketing, pyramid schemes, work-from-home offers, or get-rich-quick programs
- Cryptocurrency speculation, penny stocks, stock alerts, or unregulated financial or investment products
- Prescription drugs, online pharmacies, or telehealth solicitations from unverified sources
- Phishing, fraud, deception, impersonation, or scams
- Purchased contact lists, third-party list rental, or unverified data sources for any of the above categories
- Any content that is illegal in the jurisdiction of either the sender or the recipient
- Any other content category prohibited by Twilio, the Campaign Registry, CTIA guidelines, or wireless carriers from time to time
This list is not exhaustive. BlastDash reserves the right to update prohibited categories at any time to remain in compliance with carrier and provider policies. You agree not to request, and BlastDash will not send, any content within these prohibited categories. Any attempt to circumvent this Acceptable Use Policy constitutes a material breach of this Agreement.
9. Messaging Compliance
BlastDash will register your sending number(s) for A2P 10DLC compliance as required by wireless carriers. BlastDash will include opt-out language (e.g., “Reply STOP to opt out”) in all SMS/MMS messages as required by law. BlastDash will honor all opt-out requests promptly and remove opted-out contacts from future campaigns. You agree not to request that BlastDash send messages that are deceptive, fraudulent, illegal, or that violate any applicable law or regulation.
10. Content Approval
BlastDash will develop campaign content based on the strategy and direction agreed upon during the onboarding process. You are responsible for reviewing and approving the initial campaign calendar and messaging direction during onboarding. Once approved, BlastDash will execute campaigns according to the agreed schedule without requiring per-message approval. If you wish to modify scheduled content, you may request changes by contacting BlastDash. Reasonable modification requests are included in your plan at no additional charge, provided they fall within your message allotment.
11. Right to Refuse, Suspend, or Terminate
BlastDash reserves the right, at its sole discretion and without liability, to: (a) refuse to send any message, run any campaign, or onboard any Client that BlastDash believes may violate carrier policies, applicable law, the Acceptable Use Policy, or any other provision of this Agreement; (b) suspend services to any Client whose account is past due, who fails to provide requested information, or who is the subject of a complaint, investigation, or carrier action; and (c) terminate this Agreement immediately, without refund, for any material breach by Client, including without limitation any violation of the Acceptable Use Policy or any conduct that exposes BlastDash, its providers, or its other clients to legal, financial, or reputational risk.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR ACCURACY. BLASTDASH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES, OR THAT MESSAGES WILL BE DELIVERED TO ANY SPECIFIC RECIPIENT, IN ANY SPECIFIC TIMEFRAME, OR AT ALL. WIRELESS CARRIERS AND MESSAGING PROVIDERS MAY THROTTLE, FILTER, OR BLOCK MESSAGES AT THEIR DISCRETION, AND BLASTDASH IS NOT RESPONSIBLE FOR SUCH ACTIONS OR FOR ANY RESULTING LOSS OR DAMAGE.
13. Limitation of Liability
BlastDash provides marketing services on a best-effort basis. We do not guarantee specific results, including but not limited to open rates, click-through rates, conversion rates, or revenue outcomes. BlastDash shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service. BlastDash’s total liability to you for any claim arising from this Agreement shall not exceed the total fees paid by you in the three (3) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless BlastDash, its owners, partners, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from: (a) your breach of this Agreement, (b) your violation of any law or regulation, (c) the content of messages sent on your behalf, (d) your provision of contact lists that were not collected with proper consent, or (e) any chargeback or payment dispute initiated by you in violation of Section 5.
15. Force Majeure
BlastDash will not be liable for any failure or delay in the performance of its services caused by circumstances beyond its reasonable control, including without limitation: acts of God; natural disasters; pandemics; war, terrorism, or civil unrest; governmental action or regulation; wireless carrier outages, throttling, blocking, or service degradation; failures or service interruptions of third-party providers (including but not limited to Twilio, Stripe, Vercel, Supabase, or any wireless carrier); internet or power outages; cyberattacks; or any other event of force majeure.
16. Modifications to Terms
BlastDash reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website and will take effect immediately upon posting. Your continued use of the service after any modification constitutes acceptance of the updated terms.
17. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
18. Entire Agreement
This Agreement constitutes the entire agreement between you and BlastDash regarding the subject matter herein and supersedes all prior or contemporaneous communications, whether written or oral.
